Legal Commentary & Landmark Judgments: Section 51
In contracts consisting of reciprocal promises to be simultaneously performed, neither party is bound to perform their obligation unless the counterparty is ready and willing to perform their concurrent promise. This statutory rule establishes the doctrine of concurrent conditions, preventing one party from enforcing performance while remaining unready or unable to discharge its own obligation.
Section 51 works in tandem with Section 16(c) of the Specific Relief Act, 1963. In any suit for specific performance, the plaintiff's failure to establish continuous readiness and financial willingness to perform their reciprocal obligation results in mandatory dismissal.
