Legal Commentary & Landmark Judgments: Section 185
Section 185 enacts an express exception to the general doctrine of consideration, declaring that no consideration is necessary to create a legally binding and enforceable contract of agency.
In pleadings, never demur that an agency agreement lacked consideration. Gratuitous powers of attorney, family agency arrangements, and informal commercial representations are completely valid under Section 185. A defense asserting 'lack of consideration' against an agent's authority will be summarily struck down.
