Key Landmark Precedents:
  • Internet and Mobile Association of India v. RBI (2020) 10 SCC 274: The Supreme Court recognized that statutory investor protection funds ensure financial sector accountability and safeguard consumer assets in institutional finance.
  • Sahara India Real Estate Corp. v. SEBI (2012) 10 SCC 603: The Supreme Court emphasized the paramount public interest in statutory investor protection funds administered by regulatory authorities to ensure restitution to retail investors.
Legal Commentary:

The IEPF Authority holds tens of thousands of crores of rupees in unclaimed corporate capital. Section 125 provides legal standing for shareholders and legal heirs to recover long-forgotten family shares and dividends. The section also provides an institutional mechanism to fund investor class action litigation under Section 245, empowering retail investors to challenge fraudulent corporate actions.
