National Floor Minimum Wages Scheme
Section 9 – Code on Wages, 2019Section 9 of The Code on Wages, 2019 establishes the statutory mechanism for fixing the National Floor Minimum Wage by the Central Government across India. Different floor wages may be fixed for different geographical areas, taking into account the minimum living standards of workers and regional cost-of-living indices.
| Statutory Principle | Governing Section | Binding Legal Mandate |
|---|---|---|
| Floor Wage Primacy | Section 9(2) | No State Government can fix a minimum wage rate that is lower than the National Floor Minimum Wage determined by the Central Government. |
| Protection Against Wage Reductions | Section 9(3) | If an existing State minimum wage is higher than the newly notified National Floor Wage, the State Government is strictly prohibited from reducing it. |
| Tripartite Consultation | Section 42 & Sec 9(1) | Floor wages must be fixed after mandatory consultation with the Central Advisory Board comprising equal employer, employee, and independent members. |
Statutory Deductions Ceiling & Wage Protection
Section 18 – Permissible DeductionsSection 18 strictly regulates deductions that an employer can make from an employee's wages. To prevent debt-trap exploitation, the law imposes an absolute ceiling:
Exhaustive List of Authorized Deductions: Fines (Sec 19), absence from duty, damage or loss of goods expressly entrusted, house accommodation provided by employer, recovery of advances/loans, income tax, statutory provident fund/ESI contributions, and court attachment orders.
Overtime Wage Mandate & Double Rate Standard
Section 14 – Overtime WagesWhere an employee works on any day in excess of the number of hours constituting a normal working day (typically 8 to 9 hours), the employer is statutorily bound to pay overtime wages at not less than twice the normal rate of wages. Non-payment of overtime attracts immediate prosecution under Section 54.
Statutory Wage Periods, Payment Timelines & 10x Claims Recovery
Section 17 & Section 45Payment Timelines (Section 17): Monthly wages must be paid within 7 days of month end. Terminated/resigned workers must receive all dues within 2 working days.
Claim Redressal & 10x Penalty (Section 45): Claims for under-payment of wages or illegal deductions can be filed before the Authority within a statutory limitation of 3 years. The Authority is empowered to direct compensation up to 10 times the amount of claim against delinquent employers.
