Legal Commentary & Landmark Judgments: Section 307

Section 307 penalises theft committed after preparation having been made for causing death, or hurt, or restraint, or fear of death, hurt, or restraint, in order to the committing of such theft.

  • Commission of Theft: Theft of movable property.
  • Prior Lethal Preparation: The thief makes advance preparation to cause death, hurt, or restraint (carrying firearms, knives, or ropes).
  • Facilitating Escape or Theft: Prepared to deploy violence to effect the theft or secure escape.
Key Landmark Precedents:
  • Ashfaq v. State (Govt. of NCT of Delhi) (2004) 3 SCC 116: The Supreme Court held that carrying deadly weapons while committing house theft satisfies the element of prior preparation even if weapons are not ultimately discharged.
  • State of Maharashtra v. Joseph Mingel Koli (1997) Cri LJ 3144: Affirmed that armed preparation by house-breakers elevates simple theft into an aggravated felonious category.
Courtroom Practice & Strategic Litigation Guidance:

Recovery of concealed weapons (daggers, pistols, chloroform) from the accused at the crime scene is vital. Defence can demonstrate that the article was an innocent trade tool (crowbar, electrician pliers).
