Legal Commentary & Landmark Judgments: Section 140

Section 140 penalizes kidnapping or abducting in order to murder or for ransom, establishing capital punishment or imprisonment for life for kidnapping for ransom, and imprisonment up to ten years for kidnapping to murder.

  • Two Aggravated Abduction Offenses: Sub-section (1): Kidnapping or abducting in order to murder or dispose of so as to be in danger of murder carries imprisonment up to ten years, and fine. Sub-section (2): Kidnapping for ransom, demanding money or compelling government to act under threat of death or hurt.
  • Death Penalty for Ransom Kidnapping: Kidnapping for ransom under sub-section (2) carries death or imprisonment for life, and fine (formerly Section 364A IPC).
  • Corporate & Child Hostage Security: Primary weapon against organized ransom gangs targeting business executives and children.
Key Landmark Precedents:
  • Vikram Singh v. Union of India (2015) 9 SCC 502: A three-judge bench of the Supreme Court upheld the constitutional validity of capital punishment for kidnapping for ransom under Section 364A IPC (Section 140(2) BNS), holding that kidnapping for ransom strikes at the security of society and justifies extreme deterrence.
  • Mallaiah v. State of Karnataka (2014) 15 SCC 315: Affirmed that to convict under Section 364A, the prosecution must prove three distinct steps: (1) kidnapping, (2) threat to cause death/hurt, and (3) demand for ransom.
Courtroom Practice & Strategic Litigation Guidance:

In defending against Section 140(2) BNS ransom charges, attack the third ingredient: if mobile call detail records (CDRs) or audio recordings fail to prove an explicit demand for ransom or threat to murder, the offence must be downgraded to simple kidnapping under Section 137 BNS.
