Legal Commentary & Landmark Judgments: Section 37
Section 37 mandates that all arrests and searches made under the Arms Act, 1959 shall be carried out in accordance with the provisions of the Code of Criminal Procedure, guaranteeing constitutional safeguards against arbitrary police action.
Scrutinize the police case diary to verify if the arresting officer complied with Section 37: did they record reasons before entering private premises? Were grounds of arrest furnished in writing? If the police conducted a nocturnal warrantless search without recording reasons under Section 165 CrPC / Section 185 BNSS, move for bail and file a discharge application based on fatal violation of statutory due process.
