Legal Commentary & Landmark Judgments: Section 25
Section 25 of the Arms Act is the comprehensive penal provision specifying rigorous imprisonment and fines for manufacturing, possessing, carrying, or dealing in unlicensed firearms, ammunition, or prohibited arms.
Subsequent subsections penalize illicit importation, failure to deposit arms upon licence revocation, and possession of arms in disturbed areas or with intent to disturb public peace.
Section 25 offences are cognizable and predominantly non-bailable. Following statutory amendments, mandatory minimum sentences were enhanced to eliminate judicial leniency, underscoring the state's severe penal policy against unlicensed gun culture and violent crimes.
