Legal Commentary & Landmark Judgments: Section 18

Section 18 provides a statutory right of appeal to any person aggrieved by an order of the licensing authority refusing, varying, suspending, or revoking a licence, establishing appellate forum, limitation, and quasi-judicial procedure.

  • Statutory Appellate Forum: Prescribes an appeal to the designated Appellate Authority (Divisional Commissioner or State Home Department) within thirty days of the date on which the impugned order is communicated to the aggrieved person.
  • Audi Alteram Partem and Appellate Powers: Section 18(5) mandates that the appellate authority shall give the appellant a reasonable opportunity of being heard and may confirm, vary, or reverse the order appealed against.
  • Limitation Condonation Safeguard: Section 18(2) proviso empowers the appellate authority to entertain an appeal after the expiry of the thirty-day limitation period if the appellant shows sufficient cause for the delay.
Key Landmark Precedents:
  • Ravi Kant v. Commissioner, Varanasi Division, 2007 (4) AWC 3888: The Allahabad High Court held that the appellate authority under Section 18 is a quasi-judicial tribunal bound to pass a reasoned speaking order after affording personal hearing; summary dismissals without reasons are void.
  • Ram Bilas v. State of U.P., 2010 (6) ALJ 287: The High Court ruled that an appeal under Section 18 cannot be dismissed mechanically on limitation grounds without evaluating the sufficient cause explained in the condonation application.
Courtroom Practice & Strategic Litigation Guidance:

Always exhaust the statutory appeal under Section 18 before approaching the High Court under Article 226, as High Courts frequently relegate petitioners to the Divisional Commissioner unless there is a patent lack of jurisdiction or gross violation of natural justice. File an application for interim stay of the deposit order along with the memo of appeal.
