Legal Commentary & Landmark Judgments: Section 49

Section 49 of the Arbitration and Conciliation Act, 1996 establishes that where the High Court is satisfied that a foreign award is enforceable under Chapter I of Part II, the award shall be deemed to be a decree of that Court.

  • Deemed Decree Legal Fiction: Where the Court is satisfied that the foreign award is enforceable under this Chapter, the award shall be deemed to be a decree of that Court.
  • Direct Execution under Order XXI CPC: Eliminates the historical two-stage process; the award transforms into a decree of the High Court and is immediately executable by attachment and sale of assets.
  • Exclusion of Section 34 Review: Indian courts cannot review the foreign award on merits; they can only examine the narrow objections enumerated in Section 48.
Key Landmark Precedents:
  • Fuerst Day Lawson Ltd. v. Jindal Exports Ltd., (2011) 8 SCC 333: The Supreme Court authoritatively ruled that under Section 49, the enforcement of a foreign award is a single consolidated proceeding; the moment the court finds the award enforceable, it operates as a decree ready for execution.
  • Vijay Karia v. Prysmian Cavi E Sistemi SRL, (2020) 11 SCC 1: Reaffirmed that under Section 49, execution of foreign awards must proceed expeditiously without permitting the judgment-debtor to relitigate settled factual questions.
Courtroom Practice & Strategic Litigation Guidance:

Combine your enforcement prayer with execution prayers under Order XXI CPC in your Section 47/49 petition, requesting immediate asset freezing and attachment upon the High Court recording its satisfaction of enforceability.
