Legal Commentary & Landmark Judgments: Section 33

Section 33 of the Arbitration and Conciliation Act, 1996 empowers the arbitral tribunal to correct clerical or typographical errors, give interpretations of specific points of the award upon party agreement, or make an additional award on claims presented but omitted from the award.

  • Thirty-Day Timeline for Correction: Within thirty days from receipt of the arbitral award, unless another period is agreed, a party may request the tribunal to correct computational, clerical, or typographical errors.
  • Interpretation upon Party Agreement: If agreed by parties, a party may request the tribunal to give an interpretation of a specific point or part of the award.
  • Suo Motu Correction by Tribunal: Section 33(3): Tribunal may correct any clerical or typographical error on its own initiative within thirty days from the date of the award.
  • Additional Award on Omitted Claims: Section 33(4): Within thirty days of award, a party may request an additional award as to claims presented in the proceedings but omitted from the arbitral award.
  • Extension of Section 34 Limitation: Under Section 34(3), where a Section 33 application is made, the three-month limitation period for challenging the award begins only from the date on which the tribunal disposes of the application.
Key Landmark Precedents:
  • State of Arunachal Pradesh v. Damani Construction Co., (2007) 10 SCC 742: The Supreme Court held that only a genuine application for correction or interpretation under Section 33 extends the limitation period under Section 34(3); a review petition disguised as a Section 33 application does not stop limitation.
  • Gyan Prakash Arya v. Titan Industries Ltd., (2023) 1 SCC 153: The Supreme Court authoritatively held that Section 33 is confined strictly to correcting clerical, computational, or arithmetical errors; the arbitrator has no power under Section 33 to modify the substantive award or enhance damages.
Courtroom Practice & Strategic Litigation Guidance:

If the arbitral award contains mathematical calculation errors or omits a claim for interest that was argued, file an application under Section 33 within 30 days; this will automatically extend the 3-month limitation window for filing a Section 34 challenge.
