Legal Commentary & Landmark Judgments: Section 3

Section 3 of the Arbitration and Conciliation Act, 1996 governs the receipt of written communications in arbitral proceedings, creating a statutory presumption of receipt when delivered personally, at place of business, habitual residence, or mailing address.

  • Personal Delivery or Place of Business: A written communication is deemed received if delivered to the addressee personally or at their place of business, habitual residence, or mailing address.
  • Last Known Address Service: If none of these can be found after reasonable inquiry, deemed received if sent to the last-known place of business, habitual residence, or mailing address by registered letter or other traceable means.
  • Deemed Date of Delivery: Deemed to have been received on the day it is so delivered.
  • Exclusion of Court Proceedings: Section 3(2) clarifies that this section does not apply to written communications in court proceedings.
Key Landmark Precedents:
  • State of Maharashtra v. Ark Builders (P) Ltd., (2011) 4 SCC 616: The Supreme Court authoritatively held that under Section 31(5) read with Section 3, delivery of a signed copy of the arbitral award to the party itself (not merely to the advocate) is a mandatory condition precedent for limitation to begin under Section 34(3).
  • Union of India v. Tecco Trichy Engineers & Contractors, (2005) 4 SCC 239: Reaffirmed that in corporate or governmental entities, service under Section 3 must be delivered to the specific officer empowered to deal with arbitration.
Courtroom Practice & Strategic Litigation Guidance:

Always dispatch Section 21 invocation notices, statements of claim, and arbitral communications via registered speed post with tracking delivery confirmation AND verified corporate email to establish conclusive deemed service under Section 3.
